TERMS AND CONDITIONS
1. GENERAL PROVISIONS
1.1. These Terms and Conditions (hereinafter referred to as the “Terms”) are a legally binding document between the Buyer and the Seller (hereinafter – the “Seller”), which sets out the rights and obligations of both Parties.
1.2. The Seller reserves the right to modify, amend, or supplement these Terms at any time. The Buyer will be informed of any changes through the Seller’s online store website.
2. CONCLUSION OF THE PURCHASE–SALE AGREEMENT
2.1. The purchase–sale agreement between the Buyer and the Seller is considered concluded when the Buyer, have read and agreed to these Terms, forms and submits an order for goods through the online store.
3. RIGHTS OF THE SELLER
3.1. In the event of important circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer.
3.2. If the Buyer attempts to disrupt the online store’s functioning, stability, or security, or fails to fulfill their obligations, the Seller has the right to restrict or suspend the Buyer’s access to the online store without prior notice.
4. OBLIGATIONS OF THE SELLER
4.1. The Seller undertakes to provide access to the online store services as defined by these Terms.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer according to the delivery method chosen by the Buyer and under the conditions set forth in these Terms.
4.3. If, due to unforeseen circumstances, the Seller cannot deliver the goods ordered in the online store, the Seller has the right to terminate the purchase–sale agreement after notifying the Buyer. The Seller may offer a replacement product of equivalent quality. If the Buyer refuses, the Seller undertakes to refund the paid amount within three (3) business days.
4.4. If the Buyer exercises the right provided in clause 5.2 of these Terms, the Seller undertakes to refund the Buyer within five (5) business days from the date the returned goods are received.
4.5. The Seller may withhold the refund until the goods are returned or until the Buyer provides proof that the goods have been sent back to the Seller—whichever occurs first.
5. RIGHTS OF THE BUYER
5.1. The Buyer has the right to purchase goods from the online store in accordance with these Terms.
5.2. The Buyer has the right to withdraw from the purchase–sale agreement concluded in the online store by notifying the Seller in writing no later than within fourteen (14) calendar days from the date of delivery of the goods.
5.3. The Buyer may exercise the right specified in clause 5.2 only if the goods have not been damaged, have not changed substantially in appearance, and have not been used.
6. OBLIGATIONS OF THE BUYER
6.1. The Buyer must pay for the purchased goods and accept them in accordance with the procedure established in these Terms.
6.2. If, without valid reason, the Buyer refuses to accept the goods upon delivery, the Buyer must cover the cost of returning the goods to the Seller upon request.
6.3. Upon delivery, the Buyer must inspect the parcel and the goods together with the Seller or the delivery representative to ensure that the shipment and goods are in good condition.
6.4. By using the online store, the Buyer confirms that they have read, understood, and agree to comply with these Terms and Conditions of Sale.
7. PRICES OF GOODS
7.1. All product prices in the online store are indicated in euros (EUR) and include VAT. Once the order is confirmed, the applicable delivery fee (if any) will be added to the total amount.
8. ORDERING AND PAYMENT
8.1. When visiting the online store, the Buyer selects the desired goods and adds them to the shopping cart. After the cart is formed, the Buyer provides the personal details necessary for order fulfillment: name, surname, delivery address, phone number, and any additional information important for the delivery of the goods. The Buyer confirms that they have read and agree to these Terms before confirming the order.
8.2. Payment can be made via Swedbank, SEB, Luminor, Citadele, or Šiaulių Bankas online banking services, as well as by Visa / MasterCard payment cards.
All payments are processed in euros (EUR) through the MakeCommerce.lt payment platform.
9. DELIVERY OF GOODS
9.1. When placing an order, the Buyer must provide an accurate delivery address.
9.2. The Buyer must personally accept the goods. If the Buyer cannot do so, but the goods are delivered to the specified address, the Buyer may not make claims regarding delivery to an incorrect recipient.
9.3. The Seller delivers the goods according to the delivery times indicated in the product descriptions.
9.4. All product characteristics are described in the product listings.
The Seller is not responsible if the color, shape, or other visual parameters of the goods displayed in the online store differ slightly from the actual goods due to the Buyer’s monitor settings or other technical factors.
9.5. If the Buyer withdraws from the purchase–sale agreement, all amounts paid by the Buyer, including delivery costs, shall be refunded.
9.6 Customs, import duties, taxes, and any additional fees for orders delivered outside the European Union are the responsibility of the customer/recipient and are not included in the product or shipping price. EVEMX Designs is not responsible for any customs delays, duties, or import charges applied by the destination country.
10. RETURN OF GOODS
10.1. High-quality goods may be returned within fourteen (14) days from the date of receipt.
Defective goods are repaired, replaced, or refunded in accordance with the Civil Code of the Republic of Lithuania.
10.2. When returning goods, the following conditions must be met:
10.2.1. The item must be in its original and undamaged packaging (this does not apply to defective goods);
10.2.2. The item must not be damaged by the Buyer;
10.2.3. The item must be unused and retain its commercial appearance – labels, protective films, and other elements must be intact (this does not apply to defective goods);
10.2.4. The item must be returned in full set, as received by the Buyer (this does not apply to defective goods);
10.2.5. The Seller has the right to refuse to accept returned goods if the return conditions have not been met;
10.2.6. Goods must be returned using the Seller’s specified return method within fourteen (14) days from the date of receipt (this does not apply to defective goods – in such cases, goods are returned within the statutory warranty period).
10.3. The return and exchange of goods of suitable quality shall be carried out in accordance with Article 6.22810(1) of the Civil Code of the Republic of Lithuania.
10.4. For goods accepted by the Buyer but later returned, the money paid will be refunded to the Buyer’s account no later than within five (5) business days from the date the goods are received by the Seller, unless otherwise agreed between the Parties.
10.5. Custom-made or personalized products (including items produced based on the Buyer’s specifications, design, or personalization requests) cannot be returned or exchanged, except in cases where the product is defective or does not meet the agreed specifications.
This exception complies with Article 6.228(10)(2) of the Civil Code of the Republic of Lithuania and EU Directive 2011/83/EU on consumer rights.
11. FINAL PROVISIONS
11.1. These Terms are prepared in accordance with the laws of the Republic of Lithuania.
11.2. These Terms and all legal relations arising between the Parties shall be governed by and interpreted in accordance with the laws of the Republic of Lithuania.
11.3. Any disputes arising from the implementation of these Terms shall be resolved through negotiations.
If no agreement is reached, disputes shall be settled according to the laws of the Republic of Lithuania.
11.4. The Parties shall be released from liability for non-performance of obligations under these Terms if such non-performance is due to unforeseen circumstances beyond their control (force majeure).
