PRIVACY POLICY
1. MAIN TERMS
1.1. Company or Data Controller – Evemx, MB, a private limited liability company established and operating under the laws of the Republic of Lithuania, legal entity code No. 307412543, registered office address: Navaršonių g. 33, Navaršonių k., LT-38365 Panevėžio r.
1.2. Client or Data Subject – a natural person who is a customer of the Company (including website visitors) whose personal data are collected by the Company.
1.3. Online Store – the Company’s online store available at evemxdesigns.com.
1.4. Services – all services provided by the Company.
1.5. Personal Data – any information relating to an identified or identifiable natural person (the Data Subject); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to their physical, physiological, psychological, economic, cultural, or social identity.
1.6. Processing of Personal Data – any operation or set of operations performed on personal data, such as collection, recording, accumulation, storage, classification, grouping, linking, modification (addition or correction), provision, publication, use, logical and/or arithmetic operations, search, dissemination, destruction, or any other action.
1.7. Partner – a legal entity providing services to the Company related to its business activities, selling goods to it, or carrying out joint projects with the Company, including but not limited to marketing campaigns, joint sales promotions, loyalty programs, etc., in the media, online, in the Online Store, retail outlets, and trading networks.
1.8. Cookie – a small piece of textual information automatically created while browsing a website and stored on the visitor’s computer or other device.
1.9. Direct Marketing – activity intended to offer goods or services to individuals or to seek their opinion about such goods or services by mail, telephone, or other direct means.
1.10. Privacy Policy – this document, which defines the principles and rules for the processing of Personal Data when using the Online Store’s services.
1.11. Account – the Client’s main login details for the Online Store, consisting of one email address and a password.
1.12. Password – a unique combination of numbers, letters, or other symbols created by the Client to access their Online Store Account.
2. GENERAL PROVISIONS
2.1. The Client grants the Company the right to perform all Personal Data processing actions to the extent and for the purposes specified in this Privacy Policy.
2.2. Personal Data are processed in accordance with the Law on Legal Protection of Personal Data of the Republic of Lithuania, the General Data Protection Regulation (GDPR), and other applicable legislation, as well as this Privacy Policy.
2.3. The Company processes Personal Data in accordance with the following principles:
- Personal Data shall be collected for specified and legitimate purposes;
- Personal Data shall be processed accurately, fairly, and lawfully;
- Personal Data shall be adequate and not excessive in relation to the purposes for which they are collected and further processed;
- Personal Data shall be kept up to date;
- Personal Data shall be stored no longer than necessary for the purposes for which they were collected and processed;
- All information about Personal Data shall be treated as confidential;
- The Client’s Personal Data shall not be used for any unlawful purpose.
2.4. By purchasing from the Online Store, the Client is deemed to have read and agreed to the current version of this Privacy Policy. If the Client does not agree with any part of the Policy, they must refrain from placing an order or purchasing products through the Online Store.
2.5. The Privacy Policy is available in the Online Store and may be printed at any time. The Company may amend, supplement, or update the Policy at its discretion. The new version will be published in the Online Store.
2.6. The Client may place an order in the Online Store either without registration or through a personal Account.
2.7. Upon initial registration, the Client must provide a valid email address, create a secure Password, and provide accurate Personal Data. The Client is responsible for the accuracy of the information. Upon creating an Account, the Client is assigned an identification code.
2.8. When using the Services or purchasing from the Online Store, the Client must always provide accurate Personal Data and is responsible for their correctness.
2.9. The Client has the right to modify or supplement Personal Data in the Account at any time or to request the deletion of the Account.
2.10. The Client must not disclose their Password to third parties and must keep it secure; otherwise, the Client assumes full responsibility for any consequences.
3. COLLECTION, USE, CORRECTION, AND STORAGE OF PERSONAL DATA
3.1. The Company respects each Client’s right to privacy. The Client’s Personal Data (name, surname, email address, phone number, delivery address, age/date of birth, payment details, purchase history, and – with consent – gender and residence location) are collected and processed for the following purposes:
3.1.1. For electronic commerce purposes:
Processed data include the Client’s name, surname, email address, phone number, delivery address, age/date of birth, IP address, and payment data.
Storage period: five (5) years from the last login to the Online Store.
3.1.2. For direct marketing purposes:
Processed data include name, surname, phone number, email address, address, age, gender, date of birth, and residence location.
Storage period: five (5) years from the last login to the Online Store.
3.2. The Client may consent to the processing of their Personal Data for direct marketing purposes. If the Client withdraws such consent, the Company will stop processing the data for these purposes and will cease sending marketing communications (except information related to the Client’s orders).
3.3. The Client may withdraw consent at any time by emailing evemx@info.com, clearly indicating the withdrawal of consent for direct marketing purposes.
3.4. The Client may also unsubscribe via the link provided in each marketing email.
3.5. As a Data Subject, the Client has the following rights:
- To obtain information about the processing of their Personal Data;
- To know from which sources and what Personal Data are collected, for what purpose they are processed, and to whom they have been disclosed during the past year;
- To request correction, deletion, or suspension of Personal Data processing when data are processed unlawfully.
3.6. To exercise these rights, the Client must provide identification (passport, ID card, or driver’s license). Requests can be submitted by email to evemx@info.com. The Company may act on such requests only after verifying the Client’s identity.
3.7. Personal Data are not disclosed to third parties except in the following cases:
- When the Client has given consent;
- To Partners providing services related to the Company’s activities;
- To competent authorities where required by Lithuanian law.
3.7.2. Payments in the Online Store are processed via the MakeCommerce.lt platform, operated by Maksekeskus AS (Liivalaia 45, Tallinn 10145, Estonia, reg. no. 12268475). Therefore, Personal Data necessary to complete and confirm payments will be transmitted to Maksekeskus AS.
3.8. The Client is aware of their right to object to the processing of Personal Data for direct marketing purposes.
3.9. The Client agrees that their Personal Data may be transferred to Partners for order fulfillment or service provision as described above.
3.10. If the Client does not agree with this Privacy Policy, they cannot use the Online Store services.
3.11. The Company implements appropriate organizational and technical measures to protect Personal Data from accidental or unlawful destruction, alteration, disclosure, or any other unlawful processing.
3.12. In cases required by competent authorities, or when Personal Data may have been used in illegal activities or identity theft investigations, the Company may store such data longer than the period defined in this Policy.
3.13. Upon receiving a Data Subject’s request regarding Personal Data, the Company will respond within 30 calendar days from the date of receipt.
3.14. To provide full functionality of the Online Store, the Company uses cookies to identify returning users, collect website traffic statistics, and manage shopping carts. The Client may review or delete cookies at any time.

4. OTHER PROVISIONS
4.1. The Company reserves the right to amend or supplement this Privacy Policy at any time. All changes take effect upon their publication in the Online Store.
